Loyalty Program Terms & Conditions
1. Definitions
- Agreement — these Terms & Conditions;
- Company — LLC "Gastronome Georgia" (ID 418473547), which is the owner and organizer of the loyalty program;
- Loyalty Program (Program) — an incentive system developed by the Company that enables the customer to benefit from special discounts based on their purchase history;
- Customer — any individual who registers in the Program, agrees to the rules, and holds an active loyalty card;
- Registration — the customer's completion of the mandatory personal data requested in the registration form for the purpose of joining the Program, and the installation of the Program card into the mobile phone's electronic wallet;
- Personal Data — the customer's personal data requested in the registration form — first name, last name, date of birth, personal ID number or passport number, email address, and mobile phone number;
- Active Account — the customer's account on which the received discount is applied;
- Barcode — the unique code displayed on the digital card, by means of which the purchase history is recorded and the corresponding discount is redeemed (as well as identification of the customer or merchant);
- Last Full Calendar Month Spend — the total value of purchases made during the one full calendar month preceding the current month. This figure determines the discount percentage.
- Status — the customer's discount level in the Program (0%, 3%, 5%, 7%, or 10%), which is reviewed on the 1st (first) day of each calendar month and depends on the last full calendar month spend.
- SMS-OFF — a simplified mechanism for opting out of marketing messages (sending a designated word/code in reply to a short number, e.g. "NO");
- PUSH Notification — a message sent by the digital card to the mobile phone;
- Transaction — any paid operation (purchase) carried out within the "Gastronome" gourmet store network that is recorded using the loyalty card;
- Account Suspension — a temporary restriction of access to the account;
- Account Cancellation — full deactivation of the account and exclusion from participation in the Program.
2. General Provisions
2.1. This document defines the rules and conditions for participation in the loyalty program of LLC "Gastronome Georgia" (ID 418473547) (hereinafter — the "Company"), at the establishment Gastronome.
2.2. By completing the registration of the digital card and selecting the "I agree" ("accept") button, the customer expresses consent to the rules and conditions set out herein and confirms that they have fully reviewed the Program policy.
2.3. The loyalty program (hereinafter the "Program") is a product created by LLC Gastronome Georgia, the purpose of which is to reward loyal customers.
2.4. Within the Program, only purchases made within the "Gastronome" gourmet store network are recorded to the customer's personal account, on the basis of which they are assigned the corresponding status and discount.
3. Joining the Loyalty Program
3.1. Any individual who has reached the age of 18 may participate in the Program.
3.2. Registration is done by scanning a QR code, or by going directly to the registration link and entering personal data.
3.3. The loyalty card is personal, and its transfer to another person is not permitted.
4. Description of the Loyalty Program
4.1. The loyalty program is a system created by the Company that enables the customer to receive a corresponding discount based on the last full calendar month spend. The discount system is progressive and is defined by tiers: 0%, 3%, 5%, 7%, and 10%.
4.2. The discount percentage depends on the amount of the customer's last full calendar month spend made at Gastronome stores:

4.3. Status upgrade: If the last full calendar month spend exceeds the threshold of the next tier, the customer is assigned a higher status, in accordance with the figures defined in clause 4.2..
4.4. Status retention: If the customer's activity decreases and the last full calendar month spend falls below the corresponding threshold, their discount percentage is automatically adjusted (reduced) in accordance with the figure defined in clause 4.2.. A status reduction is carried out gradually: at each recalculation, the customer's status decreases by a maximum of one tier (no more than one tier per month).
4.5. New customer status: A customer registering in the Program for the first time is automatically granted, as a gift, a 3% discount upon registration, which is valid for 1 calendar month. From the following month, their status is recalculated in accordance with the general rule defined in clause 4.2..
4.6. Existing customer status: Existing loyalty card holders, upon transition to the new system, have their initial discount percentage determined based on their last full calendar month spend, in accordance with the figures defined in clause 4.2.. If, during the last full calendar month, an existing customer was inactive and, accordingly, a discount figure of 0% was determined, then upon transition to the new Program such customers are granted, as a gift, a 3% discount for 1 calendar month.
4.7. Status visualization: Displaying the current discount % is an integral part of the design of the digital loyalty card added to the Wallet, which enables the customer to verify their status at any time.
4.8. Spending points accumulated under the old system: In connection with the transition to the new model, customers have until 1 September to use (spend) the balance of points accumulated under the old system. The counting of this deadline begins from the date on which the Company sends informational SMS or E-mail messages and from the date of the announcement posted on social media. In the event that the customer's contact information has changed, is incomplete, or was provided incorrectly from the outset, the Company's informational obligation is deemed fulfilled from the moment of publication of the announcement on social network(s). The Company assumes no responsibility in cases where the customer has not updated their data or has otherwise failed to provide it correctly to the Company. Under these conditions, the customer is deemed to have been duly informed.
4.9. Cancellation of points: Upon expiry of the deadline indicated in clause 4.8. of this document, any unused balance (accumulated points/GEL) on the old cards is fully cancelled. Restoration of these points and/or their transfer to the new application will not be carried out.
4.10. Card activation: From registration of the card (installation on the smartphone) to its full activation, 1 (one) business day may be required. In such case, the customer will be able to use the discount on the business day following registration.
4.11. For the purpose of efficient management of the system, the Company reserves the right, without prior notice, to cancel the electronic card and membership in the loyalty program if the customer remains in an inactive (0%) status for 6 (six) consecutive calendar months.
5. Rights of the Company
The Company is entitled to:
5.1. Suspend or cancel a customer's account in the event that abuse of the loyalty program is detected, incorrect or false information is provided, the account is transferred to a third party, technical systems are breached, or any other action is taken that violates these rules or applicable legislation;
5.2. At any time, without prior notice, change or update the monetary (spend) limits defined for status and/or other conditions. The updated conditions are automatically reflected both in the card's information section via link and on the Company's corresponding web page, and take effect upon publication.
5.3. Temporarily suspend the operation of the Program for technical reasons.
6. Processing of Personal Data (Privacy Policy and Personal Data Collection)
6.1. By registering in the application, the customer expresses their will and gives the Company unconditional consent to process their personal data in accordance with the Law of Georgia "On Personal Data Protection".
6.2. The processed data includes: first name, last name, personal ID number or passport number, phone number, email address, date of birth, the customer's consent and the date of its issuance/version of the rules, and transaction history (products purchased, amount spent, time and place of visit).
6.3. To ensure the servicing of the digital wallet (Wallet) card and to provide technical support, the Company collects and stores device information related to the customer's card (pass) (device type, and the identifier of the link used at first installation (store establishment or social network). The Company does not store IP addresses or location coordinates.
6.4. Purposes of data processing:
6.4.1. Administration of the loyalty program and calculation of discounts;
6.4.2. Improvement of service quality and analysis of customer behavior;
6.4.3. Informing the customer about individually tailored offers and news.
6.5. The Company undertakes to protect the security of the data and not to transfer it to third parties, except in cases provided for by law or to those technical partners who ensure the proper functioning of the application (with a guarantee of confidentiality).
6.6. The customer has the right at any time to request information about the processing of their data, and to request its correction, update, or deletion. A request to delete data may be made by the customer by sending a message to the email indicated in the Company's contact settings. Deletion of data results in cancellation of the loyalty account.
6.7. Data is stored during the period of participation in the Program and for 1 (one) year after its completion, in accordance with legislation.
7. Marketing Communication and Opting Out (Opt-out)
7.1. By registering for this agreement, you agree to receive messages about news, promotions, gifts, campaigns, and status in the form of application (Push), SMS, and email (E-mail).
7.2. Push notifications: You can disable these from your mobile phone's notification settings at any time.
7.3. SMS messages: Opting out of receiving marketing SMS messages is possible at any time, by sending a reply in the manner indicated in the message (for example, by sending the word "NO").
7.4. E-mail messages: Opting out of E-mail messages will be possible by following the unsubscribe link.
7.5. Opting out of SMS and E-mail messages excludes the receipt of marketing-content messages but does not exclude critical messages related to your account.
8. Terms of Use of the Application
8.1. The digital card can be activated on iOS and Android platforms;
8.2. On the back of the digital card (by entering the information — "Info" or "Detail" — section), the customer can review the conditions of statuses and other benefits. A direct link to the personal data processing policy and to these Terms & Conditions is also placed there.
8.3. The customer is obliged to protect the security and confidentiality of their account. They must immediately notify the Company if there is suspicion of unauthorized use of their account.
8.4. The Company is not responsible for damage arising as a result of the customer's violation of security rules (e.g., use of the discount by a third party).
8.5. The Company is not responsible for damage caused by technical disruption, however it ensures the elimination of the fault within a reasonable time.
8.6. The Company is not responsible for:
- the actions of third parties;
- incorrect use of the account by the customer;
- disruptions caused by technical faults;
- delays in status updates caused by technical faults.
9. Additional Restrictions
9.1. The discount card may only be used by the authorized customer;
9.2. The discount does not apply to:
9.2.1. products that are on promotion;
9.2.2. the purchase of gift cards;
9.2.3. the Company is entitled to define additional restrictions on specific products.
9.3. The Company reserves the right, in the event of suspicion of abuse of the Program (e.g., use of one card by many different persons), to temporarily or permanently block the customer's loyalty card.
10. Final Provisions
10.1. These conditions take effect from the moment of the customer's registration.
10.2. Any dispute that may arise between the parties is resolved through negotiation, and in the event of failure to reach agreement — in accordance with the applicable legislation of Georgia.
10.3. The Company reserves the right to change the discount percentages or the principle of status assignment, in accordance with clause 5.2..
